1About this policy.
This Privacy Policy explains how SMSF Financial Solutions Pty Ltd (ACN 627 878 175, ABN 74 627 878 175) and its related entities collect, hold, use, disclose and protect personal information. In this policy, "we", "us" and "our" refer to SMSF Financial Solutions Pty Ltd and the following related entities:
- SMSF Admin Solutions, which provides SMSF administration and accounting services
- SMSF Investment Solutions, which issues structured investment products
- SMSF Insurance Partners, which provides insurance services
SMSF Financial Solutions Pty Ltd is a Corporate Authorised Representative (CAR 1267673) of Finexia Wealth Pty Ltd (ACN 637 420 672, AFSL 522661).
We are bound by the Privacy Act 1988 (Cth) and the thirteen Australian Privacy Principles (APPs). This policy also covers our handling of tax file numbers under the Privacy (Tax File Number) Rule 2015.
This policy applies to information collected through our website at www.smsffinancial.com.au, through our client services, and through any form, tool or communication channel we operate.
2Summary.
The detail is set out below. In short:
- We collect only the personal information we need to provide our services and meet our legal obligations.
- We will tell you what personal information we hold about you if you ask.
- You can ask us to correct information that is wrong, and we will explain if we are unable to act on a request.
- We do not sell, rent or trade your personal information.
- Some of our systems and team members are located overseas, and we set out where in section 9.
- Superannuation and taxation law requires us to keep some records for set periods, so we cannot delete everything on request.

3What personal information we collect.
The information we collect depends on the nature of your dealings with us.
Website visitors and enquirers
- Name, email address and telephone number submitted through contact forms, booking forms and resource downloads
- Information you provide in an enquiry or message
Like most websites, our web servers automatically record certain technical information about your visit. This information is used for statistical and security purposes and includes:
- your server or IP address
- the date and time of your visit
- the pages you accessed and any documents you downloaded
- the website you visited immediately before ours
- the type of browser, device and operating system you used
Clients and prospective clients
- Full name, date of birth, residential and postal address, telephone numbers and email address
- Tax file number, where required for superannuation administration and taxation purposes
- Identification documents collected to verify identity
- Details of your superannuation interests, self managed superannuation fund, trustee arrangements and fund members
- Financial information including account balances, contributions, investments, income and expenses of the fund
- Employment and income information where relevant to superannuation contributions
- Bank account and payment details for fund administration
- Records of our communications with you
Insurance applicants
Where you apply for insurance through us, we may collect sensitive information, including health information and medical history. We only collect sensitive information with your consent and where it is reasonably necessary for the service you have requested.
4How we collect personal information.
We collect personal information directly from you wherever it is reasonable and practicable to do so, including when you complete a form on our website, download a resource, book a call, speak with us by telephone, correspond with us by email, or provide documents as part of establishing or administering a fund.
We may also collect personal information from third parties, including your accountant, financial adviser, mortgage broker, employer, superannuation fund, insurer, the Australian Taxation Office, and referral partners. Where we collect your information from a third party, we take reasonable steps to make you aware of that collection.
5Why we collect, hold and use personal information.
We collect, hold and use personal information for the following purposes:
- To provide general advice and dealing services in relation to self managed superannuation funds
- To establish, administer, audit and report on self managed superannuation funds
- To prepare financial statements, tax returns and regulatory lodgements
- To arrange and administer insurance
- To provide information about structured investment products
- To verify your identity and meet our obligations under anti money laundering and counter terrorism financing legislation
- To respond to your enquiries and provide the resources you have requested
- To send you newsletters, market updates, educational material and information about our services, where you have not opted out
- To maintain our client records and internal administration
- To meet our obligations under the Superannuation Industry (Supervision) Act 1993, the Corporations Act 2001, taxation legislation and the terms of our authorisation under AFSL 522661
- To manage complaints and disputes
If you do not provide the personal information we request, we may be unable to provide the services you have asked for, or may be unable to meet our legal obligations in relation to your fund.
6Tax file numbers.
Where we collect your tax file number, we do so as authorised under taxation and superannuation legislation. We use and disclose tax file numbers only for the purposes permitted by law, including lodging returns and reporting to the Australian Taxation Office. You are not obliged to provide your tax file number, however declining to do so may affect the taxation treatment of your superannuation and our ability to administer your fund.
We store tax file numbers securely and restrict access to personnel who require it to perform their duties. We do not use tax file numbers as a general identifier.
7Direct marketing.
We may use your contact details to send you newsletters, market updates, educational material and information about our services and products.
Every marketing email we send includes an unsubscribe facility. Where we send marketing messages by SMS, those messages identify us as the sender and include a means of opting out. You can also opt out at any time by contacting our Privacy Officer using the details in section 15.
We do not sell, rent or trade personal information, and we do not disclose personal information to third parties for their own direct marketing purposes. Our marketing communications are sent by us, or by our email and messaging providers acting on our instructions, and never by a third party marketing its own products to you.
8Who we disclose personal information to.
We may disclose your personal information to:
- Our related entities listed in section 1
- Finexia Wealth Pty Ltd as our licensee, for compliance, audit and supervision purposes
- Your fund's auditor, and to accountants, lawyers, actuaries and other professional advisers engaged in connection with your fund
- The Australian Taxation Office, ASIC, AUSTRAC and other government and regulatory bodies
- Product issuers, insurers, brokers, custodians and banks, where required to execute a transaction or arrange a service you have requested
- The Australian Financial Complaints Authority, in connection with a complaint
- Our technology and service providers, listed in section 9
- Any other person or organisation you have authorised
- Any person to whom we are required or authorised to disclose information by law, including under a court order, subpoena or statutory notice
9Service providers and disclosure to overseas recipients.
We use third party service providers to deliver our services. As part of these arrangements, personal information may be stored or processed on servers located outside Australia.

We also use website hosting, security and form protection providers in connection with the operation of our website. These providers may process technical information such as IP addresses for the purposes of delivering and protecting the site.
We also engage team members located outside Australia, including in the Philippines, who may access personal information in the course of providing administrative and client support services. These team members are subject to confidentiality obligations and to our internal privacy and security requirements.
Before disclosing personal information to an overseas recipient, we take steps that are reasonable in the circumstances to ensure the recipient does not breach the Australian Privacy Principles. This includes contractual obligations with our service providers and access controls for our overseas team members.
You should be aware that overseas recipients may be subject to the laws of the jurisdictions in which they operate, and that those laws may permit access to personal information in circumstances that differ from Australian law.
10Automated decision-making.
We use technology to support our operations, including website analytics, enquiry management, marketing automation and administration software.
We do not use computer programs to make decisions, or to do things substantially and directly related to making decisions, that could reasonably be expected to significantly affect your rights or interests. Decisions about the services we provide, the establishment or administration of a fund, and any advice we give involve assessment by our people.
If this position changes, we will update this policy to set out the kinds of personal information used, the kinds of decisions made, and the role automated decision-making plays in them.
11Cookies and website analytics.
Our website uses cookies. A cookie is a small data file placed on your device that allows a website to recognise your browser and remember certain information.
We use three kinds of cookies:
- Essential cookies, which are needed for the website to function, to keep a session active and to protect the site against misuse.
- Analytics cookies, placed by Google Analytics. These help us understand how many people visit the website, which pages they read and how they found us. Google Analytics assigns your device an identifier rather than identifying you by name, and we use the results to look at overall patterns rather than individual visitors.
- Marketing and enquiry cookies, placed by GoHighLevel, the system we use to manage enquiries and communications. These record the pages viewed on a device before an enquiry is made. If you submit a form on our website, the pages you viewed may become linked to your contact record, so that we understand what you were looking for when you got in touch.
We do not use advertising or retargeting pixels, and we do not run paid advertising campaigns that track visitors across other websites.
You can set your browser to refuse cookies or to notify you when a cookie is being placed. If you do so, some parts of our website may not function correctly. You can also opt out of Google Analytics across all websites by installing the Google Analytics opt out browser add on.
If you would prefer that we do not link your browsing activity to your contact record, contact our Privacy Officer using the details in section 15 and we will action that request.
12Security of personal information.
We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include:
- Access controls limiting information to personnel who require it to perform their role
- Multi factor authentication on our systems where available
- Encryption of information in transit and at rest within our core systems
- Confidentiality obligations in employment and contractor agreements
- Periodic training of our personnel on their privacy and confidentiality obligations
- Secure destruction or de-identification of information we no longer need to retain
No method of transmission or storage is completely secure. While we take our security obligations seriously, we cannot guarantee the security of information transmitted to us over the internet.
13Data breaches.
We maintain a data breach response plan. If we become aware of unauthorised access to, unauthorised disclosure of, or loss of personal information we hold, we will assess the incident promptly.
Where a data breach is likely to result in serious harm to any individual whose information is involved, we will notify those individuals and the Office of the Australian Information Commissioner in accordance with the Notifiable Data Breaches scheme in Part IIIC of the Privacy Act 1988 (Cth).
14Retention of personal information.
We retain personal information for as long as it is needed for the purposes set out in this policy, and for as long as we are required to retain it by law.
Superannuation and taxation legislation requires us to keep certain records for prescribed periods. Accounting records and transaction records relating to a self managed superannuation fund must generally be kept for at least five years. Trustee minutes, trustee declarations, changes of trustee and member reports must generally be kept for at least ten years. Identification records collected for anti money laundering purposes are subject to their own retention requirements.
When personal information is no longer required and we are no longer required by law to retain it, we take reasonable steps to destroy it or to de-identify it.
15Accessing and correcting your personal information.
You may request access to the personal information we hold about you, and you may ask us to correct it if you believe it is inaccurate, out of date, incomplete, irrelevant or misleading.

We will respond to your request within 30 days. There is no charge for making a request. We may charge a reasonable fee for the time and cost of providing access to a large volume of information, and we will tell you the amount before we proceed.
We may decline a request for access or correction in the limited circumstances permitted by the Australian Privacy Principles. If we do, we will tell you our reasons in writing and explain how you can complain about that decision.
Please note that we cannot delete all personal information on request. As set out in section 14, we are required by superannuation, taxation and anti money laundering legislation to retain certain records for prescribed periods. Where we are unable to act on a request, we will explain why.
16Complaints.
If you have a concern about how we have handled your personal information, contact our Privacy Officer using the details in section 15. Please set out your concern in writing so that we can investigate it properly.
We will acknowledge your complaint promptly and aim to provide a response within 30 days. If we need more time, we will tell you why and keep you informed.
If you are not satisfied with our response, you can refer the matter to the Office of the Australian Information Commissioner:

17Changes to this policy.
We may update this policy from time to time to reflect changes in our practices, our systems or the law. The current version is always available at www.smsffinancial.com.au/privacy-policy. Where we make material changes, we will indicate this by updating the date at the top of this policy.
