2Acceptance of these terms.

By accessing or using this website, you agree to these terms. If you do not agree to them, please do not use the website.

These terms should be read together with our Privacy Policy, available at www.smsffinancial.com.au/privacy-policy, which forms part of these terms.

3General advice warning.

This is the most important term on this page.

Any information, commentary, educational material, calculator, tool, guide or resource available on this website is general information and general advice only. It has been prepared without taking into account your objectives, financial situation or needs.

Nothing on this website is personal financial product advice. We do not, through this website, consider whether any strategy, structure, product or investment is appropriate for you. No Statement of Advice is prepared in connection with this website.

Before acting on any information on this website, you should consider its appropriateness having regard to your own objectives, financial situation and needs, and you should obtain and consider any relevant product disclosure statement or offer document. We recommend you seek professional advice specific to your circumstances before making any decision about a financial product or a self managed superannuation fund.

Past performance is not a reliable indicator of future performance. No outcome, return or result is guaranteed.

4Nature of the services described.

SMSF Financial Solutions Pty Ltd holds a general advice and dealing authorisation only. Descriptions of services on this website should be read in that context.

Where this website refers to services provided by our related entities, including SMSF Admin Solutions, SMSF Investment Solutions and SMSF Insurance Partners, those services are provided by the relevant entity under its own arrangements and terms.

No advisory relationship is created by using this website. Accessing the Website, reading its content, using a calculator or assessment tool, downloading a resource, subscribing to our communications or submitting an enquiry does not of itself create a client, advisory or fiduciary relationship between you and us. Such a relationship arises only where we have agreed with you in writing to provide services, and is governed by the terms of that engagement.

Nothing in this section limits any obligation we owe under the Corporations Act 2001 (Cth) or under the terms of our authorisation as a representative of AFSL 522661 in respect of general advice we do provide.

5Calculators, tools and assessments.

This website provides access to calculators, assessment tools and questionnaires. Some of these are hosted by us, and some are operated by third parties, including calculators published by the Australian Taxation Office.

These tools:

  • produce general illustrations based only on the inputs provided and on assumptions built into the tool
  • do not take into account your objectives, financial situation or needs
  • are not a recommendation, an offer, or a projection of any actual outcome
  • should not be relied on as the sole basis for any decision

Where a tool is operated by a third party, you leave our website when you use it, and the third party's own terms and privacy policy apply. We do not control those tools and are not responsible for their content, accuracy or availability.

6Downloads, guides and resources.

Some resources on this website are made available on the condition that you provide your name, email address and telephone number.

By submitting your details you agree that we may contact you about the resource you requested and about our services. You may opt out of those communications at any time using the unsubscribe facility in our messages or by contacting us. How we handle the information you provide is set out in our Privacy Policy.

All downloadable resources are general information only and section 3 applies to them.

7Accuracy of information.

We take care in preparing the content of this website. However, information on this website is provided for general information purposes and may not be current, complete or accurate at the time you access it.

Superannuation, taxation and financial services laws change frequently. Content that was accurate when published may no longer reflect current law or market conditions. Articles, market updates and historical material are published as at their date and are not updated.

We are not obliged to update information on this website, except as required by law.

8Testimonials.

Testimonials published on this website reflect the individual experiences of the people who provided them. They are not a guarantee, promise or prediction about the results any other person may achieve, and they are not financial product advice. Individual outcomes vary according to individual circumstances.

9Member login links.

This website contains links to third party platforms, including Class, Macquarie and Equix, through which clients may access their own account information. Those platforms are operated by third parties under their own terms and privacy policies. We are not responsible for their operation, availability or security.

10Other third party links and content.

This website may contain links to third party websites and material produced by third parties. Those links are provided for convenience only and do not constitute an endorsement.

We do not control third party websites and are not responsible for, and do not sponsor, endorse or approve, any information or link contained on them. We cannot censor or edit the content of a third party website, and we make no representation about the quality, accuracy, reliability, completeness or currency of information on it.

We are not a party to any transaction between you and the operator of a third party website. Your use of a third party website is subject to that site's own terms and privacy policy in addition to these terms. Any dealings you have with a third party are between you and that third party.

11Intellectual property.

All content on the Website, including text, graphics, logos, images, video, articles, guides, calculators, assessment tools and their selection and arrangement, is owned by us or licensed to us (Our Content).

The content management system, themes, templates and software that power the Website are owned by their respective licensors and are licensed to us (Licensed Platform). Our Content and the Licensed Platform are together referred to as the Content.

Unauthorised use of any intellectual property in the Website, the Licensed Platform or the Content may constitute a breach of the Copyright Act 1968 (Cth).

Other than as permitted under the Copyright Act 1968 (Cth) or as expressly provided in these terms, no part of the Website, the Licensed Platform or the Content may be reproduced, adapted, published, distributed, transmitted, stored in a retrieval system, sold or commercially exploited by any means, in any form, without our prior written permission.

You may view, download and print Content from the Website for your own personal, non commercial use only.

All business names, logos and trade marks appearing on the Website are owned by us or by the third parties who contributed them. Nothing on the Website grants any right or licence to use those names, logos or trade marks without express written authorisation from us or the relevant owner.

12Acceptable use.

You must not use this website:

  • for any unlawful purpose, or to encourage or assist any unlawful act
  • to infringe our intellectual property rights or those of any other person
  • to submit false, misleading or deceptive information
  • to harass, abuse, defame, threaten or discriminate against any person
  • to upload or transmit any virus, malware or other harmful code
  • to collect, scrape, harvest or track the personal information of others
  • to interfere with, disrupt or circumvent the security or operation of this website or any system connected to it
  • to send unsolicited commercial messages

You must not use, launch, or permit any other person to use or launch, any automated system, including robots, spiders, crawlers, scrapers, offline readers, data extraction tools or artificial intelligence agents, to access, index, copy or extract any part of the Website or the Content, except for search engine crawlers operating in accordance with our robots.txt file.

You must not use the Website or the Content to train, fine tune or develop any machine learning or artificial intelligence model without our prior written permission.

You must not decompile, reverse engineer, decode, copy, alter, modify, adapt, disassemble or create a derivative work of the Website, the Licensed Platform or the Content.

You must not circumvent, disable or otherwise interfere with any security related feature of the Website or the Content.

If you use this website in breach of these terms, we may suspend or restrict your access. Where it is reasonable in the circumstances to do so, we will notify you and give you an opportunity to remedy the breach before taking that step, unless immediate action is necessary to protect our systems, our clients or any other person.

13Submissions and feedback.

If you send us ideas, suggestions, feedback or other material on your own initiative, you agree that we may use that material without restriction and without any obligation to compensate you.

This clause applies only to unsolicited creative material. It does not apply to personal information, client information or enquiries you submit through this website, which are handled in accordance with our Privacy Policy and our obligations of confidence.

14Availability of the website.

We aim to keep this website available, however we do not warrant that it will be available without interruption or free of errors. We may suspend, withdraw or modify all or part of this website at any time for maintenance, security or operational reasons. Where a change is significant and we can reasonably do so, we will give notice.

15Australian Consumer Law.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

Where a guarantee under the Australian Consumer Law applies and the relevant supply is not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to comply with that guarantee is limited, to the extent permitted by law, to resupplying the services or paying the cost of having them resupplied.

16Limitation of liability.

Subject to section 15, and to the maximum extent permitted by law:

  • this website and its content are provided on an "as is" and "as available" basis
  • we do not warrant that the content of this website is accurate, complete, current or fit for any particular purpose
  • we are not liable for any loss or damage arising from your use of, or reliance on, this website or its content, or from your inability to access it
  • we are not liable for any indirect or consequential loss, loss of profits, loss of revenue, loss of opportunity or loss of data

Nothing in this section limits any liability we have under the Corporations Act 2001 or under the terms of our authorisation as a representative of AFSL 522661.

17Indemnity.

You indemnify us against any loss, damage, cost or expense we reasonably incur as a direct result of your use of this website in breach of section 12, or your infringement of the rights of any other person through your use of this website.

This indemnity does not apply to the extent that the loss was caused or contributed to by our own act or omission.

18Changes to these terms.

We may update these terms from time to time to reflect changes in our services, our systems or the law.

The current version is always available on this page and is dated at the top. Where a change materially affects your rights, we will publish notice of the change on this page for a reasonable period before it takes effect. If you do not accept a change, you may stop using the website.

Changes do not apply retrospectively to your use of the website before the change took effect.

If you have a complaint about our services, contact us using the details in section 1. We will acknowledge your complaint and aim to respond within 30 days.

If your complaint relates to a financial service and you are not satisfied with our response, you may refer the matter to the Australian Financial Complaints Authority, of which our licensee is a member:
